Speaker: Knud E. Hermansen is an attorney, professional
engineer, and professional land surveyor licensed in several states. His
education includes a Ph.D. in Civil Engineering from the Pennsylvania State
University and a J.D. (Doctorate in Law) from West Virginia University. He has
been an expert in numerous boundary dispute cases. As an attorney, he has done
direct and cross-examination of experts. Knud is a Professor at the University
of Maine and operates a consulting firm offering surveying, engineering, and
legal services. Professional membership includes the National Lawyers
Association, National Society of Professional Surveyors, American Society of
Civil Engineers, and several state survey societies and bar associations. He is
an author or co-author of the books titled: Boundary Principles and Procedures
for Pennsylvania, Residential Subdivision & Land Development in Maine, and
several other documents.
Seminar Content Descriptions:
Survey Reports & Documentation
Communications is an important part of surveying
services. Documentation is a part of the communication process. The failure of
the surveyor to provide complete and understandable documentation for the use
of the client and others is often a source of liability. This seminar will
focus on survey reports, contracts, letter to adjoiners, affidavits, and other
written forms of communication. The seminar will discuss documenting opinions,
problems, concerns, encroachments, and recommendations to avoid liability.
Duties of the Surveyor as an Expert Witness
The practice of land surveying often requires a surveyor
be prepared to effectively communicate an opinion in court. The surveyor must
be prepared to present their opinion and analysis in a clear, understandable,
and concise manner. This seminar will focus on the process, preparation,
payment, and presentation techniques. Participants will better understand how
to handle depositions, answer questions, prepare exhibits, and communicate
effectively.
Extrinsic Evidence & Boundary Surveying
Extrinsic evidence is often employed by the surveyor when
retracing boundaries. This workshop will explain what comprises extrinsic
evidence, how extrinsic evidence is used in a boundary retracement, where
extrinsic evidence can be used in a boundary retracement, and how to preserve
extrinsic evidence. And I would sooner trust the smallest slip of paper for
truth, than the strongest and most retentive memory, ever bestowed on mortal
man. Lumpkin, Joseph Henry, in Miller and others v. Cotton and others, 5 Ga.
341, 349 (1848)
Monuments and Lines of Possession
Practitioners often encounter situations where the
client’s possession boundary does not coincide with the record boundaries.
Depending upon the circumstances, the possession boundary may become the
ownership boundary. In other cases, acts of the party(ies) and surrounding
circumstances may locate the boundary that the record alone fails to fix with
clarity. The workshop will explain and discuss estoppel, acquiescence, practical
location, agreement, adverse possession, and dedication. In addition to a basic
understanding of these doctrines, the practitioner will learn what their role
and responsibilities are in these cases.
